This Privacy Policy sets forth Kalvie's policy with respect to information including personally identifiable data ("Personal Data") and other information that is collected from Site visitors and users of the Services whether it relates to our students, parents, tutors, potential tutors, and its staff. It describes what we do with the information we collect, and the choices Site visitors and users of the Services have concerning the collection and use of such information.

We reserve the right, at any time, to modify or replace the Privacy Policy. If we make changes, we will notify you by revising the date at the top of this policy. Also, if you provide Personal Data in order to obtain access to the Services, we will use your Personal Data to provide you with access to such services and to monitor your use of such services.

Kalvie and its subsidiaries and affiliates (the "Related Companies") may also use your Personal Data and other personally non-identifiable information collected through the Site to help us improve the content and functionality of the Site, to better understand our users and to improve the Services. Kalvie and its Related Companies may use this information to communicate with you regarding the Services or to tell you about services we believe will be of interest to you. If we do so, each marketing communication we send you will contain instructions permitting you to "opt-out" of receiving future marketing communications.   • - if your parents and/or your school pay for/subsidize any of your tutoring, we may share your Personal Information with them at their request. This may include the content of any (or all) of your tutoring sessions (transcripts) as well as the written comments you leave in post-session surveys. For the purposes of our Privacy Policy, your school is considered to be subsidizing your tutoring if it has negotiated a special price or trial offer for its students. On the other hand, if you pay us for your own account, without the involvement of your parents or your school, we will not share your Personal Information with them.
  • - if you use a promotion code to create a Kalvie account, or to add hours to an account, we may let the source of that promotion code know that you used that code. For example, if you sign up for Kalvie.com as part of our refer a friend program, we may let your friend know that you redeemed their refer a friend offer.
  • - we share your personal information with the vendors (companies) that help us process transactions, such as charging your credit card when you make purchases.
  • - if required to do so by law or in the good faith belief that such action is necessary to (i) comply with a legal obligation, (ii) protect and defend the rights or property of Kalvie, (iii) act in urgent circumstances to protect the personal safety of users of the Site or the public, or (iv) protect against legal liability.

Some of the third parties to whom we may disclose or transfer personal information, may be located outside your country of residence and countries we are physically located ("Third Party Countries") and personal information may therefore be disclosed, transferred, stored (including electronically) or processed in these Third Party Countries for the purposes described herein. By accessing or using our services or otherwise providing information to us, you specifically consent to the processing and transfer of your personal information in Third Party Countries. Any personal information which is disclosed, transferred, stored or processed in Third Party Countries, may be subject to legal requirements in those respective countries applicable to Kalvie or the applicable third parties.

Keeping Your Data Safe

We strive to maintain personal information in as accurate, complete and up-to-date a form as necessary to fulfill the purposes for which it was collected. We protect personal information by security safeguards appropriate to the sensitivity of the personal information, regardless of format. Our security safeguards include premises security and restricted access to files containing personal information. Depending upon the information under our control, we also use technological safeguards such as security software and firewalls to prevent hacking or unauthorized computer access, internal passwords and security policies. We use industry best practices to keep any information collected and/or transmitted to the Supported Platforms or Third-Party Apps secure. This includes the use of HTTPS with TLS (Transport Layer Security), which encrypts all transmitted data.

In addition, Kalvie uses third-party vendors and hosting partners such to provide the necessary hardware, software, networking, storage, and related technology required to run the Services. These vendors have been selected for their high standards of both physical and technological security.

Kalvie does not store credit card details on its servers. In the unlikely event that you experience unauthorized use of your credit card, promptly report the fraudulent activity to your credit card company. Please check with your credit card company to verify specific terms and conditions relating to fraudulent activity.

You should bear in mind that submission of information over the Internet is never entirely secure. We cannot guarantee the security of information you submit via the Services whilst it is in transit over the Internet and any such submission is at your own risk, and this risk is specifically disclaimed in our Terms.

If you are a Logged-in User, it is advisable that you logout of your account at the end of every session and not leave a logged-in account unattended for any period of time, particularly if you use a shared computer or device.

Exclusions

This Privacy Policy does not apply to any Personal Data collected by Kalvie other than Personal Data collected through the Site or Services. This Privacy Policy shall not apply to any unsolicited information you provide to Kalvie through this Site or through any other means. This includes, but is not limited to, information posted to any public areas of the Site, such as bulletin boards (collectively, "Public Areas"), any ideas for new products or modifications to existing products, and other unsolicited submissions (collectively, "Unsolicited Information"). All Unsolicited Information shall be deemed to be non-confidential and Kalvie shall be free to reproduce, use, disclose, distribute and exploit such Unsolicited Information without limitation or attribution.

Safety Of Children

Protecting the safety of children when they use the Internet is very important to us. Our Services should only be accessed by individuals of Minimum Age. "Minimum Age" may mean different ages in different countries, depending on where the individual accesses the services. It is the individual's responsibility to adhere to applicable law. The Services are not designed nor intended for use by children or anyone else under the minimum age of 13. However, if applicable law requires that you must be older than such ages in order for Kalvie to lawfully provide the Services to you (including the collection, storage, and use of your information in accordance with this Privacy Policy), then the Minimum Age would be such older age.
